I Moved to America… So Why Do I Still Have to File a UK Tax Return?

One of the biggest surprises for many people moving from the UK to the United States is discovering that leaving the UK doesn’t automatically end your UK tax obligations.

In fact, this is one of the most common questions I receive from UK expats.


“I’ve moved to the US. Surely I only file taxes in America now?”


Unfortunately, it’s rarely that simple.


The Answer Depends on Your Circumstances


Whether you still need to file a UK tax return

depends on several factors, including:

  • When you left the UK

  • Whether you remained UK tax resident

  • Whether you still receive UK income

  • Whether you own UK property

  • Whether you have UK investments or pensions

  • Whether you returned to the UK during the tax year


Many people assume that because they’ve moved overseas, HMRC no longer wants to hear from them. That assumption can become expensive.


You May Still Need to File if You Have:

  • Rental income from UK property

  • Self-employment income earned before leaving

  • UK pension income

  • Capital gains from selling UK assets

  • High levels of UK investment income

  • Income that requires Split Year Treatment calculations


Even if no tax is ultimately due, you may still have a filing requirement.


Don’t Forget the US Side


At the same time, once you become a US tax resident, the IRS generally taxes your worldwide income.


That means your UK income, investments, pensions and even certain tax-free UK accounts may all need to be reported on your US tax return.


This is where many expats accidentally:

  • Pay more tax than necessary

  • Miss valuable foreign tax credits

  • File incorrectly in one or both countries

  • Receive unexpected letters from HMRC or the IRS


The good news is that, with proper planning, double taxation can often be avoided.


Every Expat’s Situation Is Different


There is no one-size-fits-all answer.


Someone who moved with an E-2 visa will have different considerations from someone who moved on a Green Card. Likewise, someone who still owns a UK rental property has very different reporting requirements from someone who sold everything before leaving.
